Regardless of what is in the contract, the name itself is trademarked, therefore, anyone selling the merchandising or representing an individual or company alike, must pay royalties and compensation for doing so. A Legally binding contract should have no loopholes whatsoever all compensation, fee structures should also be attached. Its to safe guard an individual or organization. But they'res also a safety catch. Even if you have not written this into your contract, you are protected by Intellectual Property Law. This is not to say in the least that you must have a written contract to be fully protected, a verbal agreement would also be adequate. In order to sell goods and merchandising, they're would be an agreement between both parties. You cannot sell items without the permission from an artist or company to do so. Im a lawyer and I write contracts all the time. Verbal is just as important as written.
I read the post which I found very interesting. Whoever Baz has selling his merchandising makes me believe they are amateur. The reason I say this is, a professional merchandiser, resale or seller would know that they'res royalties, fees and commissions attached on each sale. Its standard Business Practice when you are selling items, merchandising or anything to do with a monetary value. I honestly cannot believe they dont know this already. They're are laws to protect Individuals, Companies and Organizations also if you do not have certain things written into your Contract.
I am somewhat perplexed about this. Maybe some people should stick to what they are competent at. They wont last very long in the game with the big boys with and an attitude like that. The Big Boys will crush him and his friend Matt in a matter of minutes, if not less than that!! No one will want to work with him if he is behaving like that now!! Kind of a warning sign dont you think?? You dont get something for nothing!!

Sebastian, great work. You should be proud. You are my favorite singer of all time. I am musician/composer. I love everything from Dream Theater to jazz to classical to beach boys, but when it comes to singing, you are the coolest. I'm so glad you sang on the Frameshift cd. My dream has been to have someone as good as you sing on my stuff. I basically have to hire guys and tell them to try and get as emotional as you, but it's not the same. I write a lot of rock stuff and I would give you writing credits in a heartbeat, just because your voice is that important. I won't get into this debate, but I want to offer my services as a guitarist and writer. I would love to write music for your voice in any style. You should work w/ some arrangers etc.....your voice is more than just rock. You were great in Jesus Christ Super star. Later.

All I know is I am a fan of Sebastian Bach for the reason that he is a 100% rocker. So many bands/singers go on stage and play....Sebastian goes on stage and lives....he is having as much fun on stage as we have fun watching and listening. I have seen him many times and that man rocks.... this Henning guy asked Sebastian to sing because nobody else can go in all those directions like him. Let the ass say what he wants .... Just one thread had been locked, the thread with all of the senseless arguing.
Fyi, no one is getting censored on Henning's board. For anything really. Someone called Henning a "four-eyed Nazi" and I am sorry but if that was my board, that mofo would have been permabanned to the moon, or at least given a week ban. But the post still remains.
There is a brand new "Absence..." thread as of June 8th... it's been up almost 2 weeks before you posted this.
As with what wildincinci is (hopefully) trying to do w/ this board, they are trying to cultivate a forum of interesting discussion about the album, not slander (that has nothing to do with the fans).

It won't play if you just click on the link. Also you have to take that line "Violence is the last resort of the incompetent" and take it in context. They are speaking about violence which is unjust. I can't imagine that you "fight" for a living, but hey if that's your gig then so be it. But if that's the case it's probably like wrestling or Ultimate Fighter or something right? Those guys are put in pre-determined matches and paid to kick the crap out of eachother...and then usually shake hands afterwards "Good job, good fight". A sport. Although honestly I don't think any kind of violence is good, but a couple of guys kicking the crap out of eachother and getting paid to do it aren't hurting me or anyone else. As long as you're not acting like the African-American in the video above -- who btw got his ass kicked right? He started the fight, and he got dropped after attacking the other guy.
